The terms and conditions for using Sold My Stuff.

Acceptance of Terms
By creating an account or using Sold My Stuff, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the marketplace.
Account Eligibility
You must be at least 18 years old to create an account and use the marketplace. By registering, you confirm that you meet this requirement and are legally able to enter into binding contracts.
Account Responsibilities
You are responsible for maintaining the security of your account and password. You agree to provide accurate information when registering and to keep your information current. You are responsible for all activity that occurs under your account.
Buying on the Marketplace
You can browse and purchase items listed by sellers. Purchases may be made at a fixed price ("Buy Now") or through auctions. When you make a purchase, you enter into a transaction directly with the seller. You agree to pay the listed price plus any applicable shipping and taxes.
Payment is processed through our third-party payment processors (Stripe or PayPal). You must complete payment during checkout. Your shipping address is shared with the seller and shipping provider to fulfill your order.
Selling on the Marketplace
To sell on Sold My Stuff, you must complete seller verification, set up a payout method, and complete your shop setup. Sellers are responsible for:
- Providing accurate listing descriptions, photos, and condition information
- Maintaining inventory availability for listed items
- Providing correct shipping information (package dimensions, weight, and battery classification)
- Fulfilling orders within the shipping deadline
- Listing only items that comply with our prohibited items policy
- Completing identity verification and payout setup
Listings
Sellers create product listings with descriptions, photos, pricing, and shipping information. Listings may be fixed-price or auction-style. Sellers are responsible for the accuracy of their listings. We may remove listings that violate our policies or applicable law.
Auctions
Auctions allow buyers to bid on items. The highest valid bid at the time the auction closes may win the item, subject to seller acceptance (for timed storefront auctions) or automatic finalization (for live show auctions).
Bidding: Each bid is a binding offer to purchase the item at the bid amount if you win. Bids must meet the minimum bid increment. Anti-sniping rules may extend the auction timer when bids are placed near the end of the auction.
Winning: For live show auctions, the highest bidder at the close of the auction is determined to be the winner and an award is created. For timed storefront auctions, the seller may accept or decline the highest bid within the acceptance window.
Payment: Winning bidders must complete payment within the payment window after the auction is awarded. Payment is made through the checkout process using a saved or new payment method. We do not automatically charge your payment method — you must complete checkout manually.
Failed payment: If payment is not completed within the payment window, the auction award may expire and the item may be returned to availability.
Live Shows
Sellers may host live streaming shows where viewers can watch, chat, and purchase featured items. Live shows use third-party streaming infrastructure to transmit video and audio. By participating in a live show, you understand that your video (if you are the host) and chat messages are visible to other participants.
Hosts are responsible for the content of their shows. We may moderate live shows and take action against shows or participants who violate our policies.
Payments
Buyer payments are processed by Stripe and PayPal. You agree to their terms when using these services. We store transaction records and payment status but do not store your full card or bank account numbers.
Seller Payouts
Sellers receive payouts through Stripe Connect or PayPal, depending on their chosen payout method. Payouts are subject to a hold period after delivery before funds are released. Marketplace fees and payment processing fees are deducted from payouts. Sellers should review the current fee schedule in their seller dashboard for applicable commission and processing rates.
Shipping
Sellers are responsible for shipping purchased items using the shipping options provided. Shipping rates are calculated based on package dimensions, weight, and destination. Tracking information is provided once a label is generated. Buyers and sellers should use tracking to monitor delivery status.
Cancellations, Refunds & Disputes
Buyers may request order cancellations under certain conditions. If an issue arises with a purchase, buyers and sellers should first attempt to resolve it through messaging. If the issue cannot be resolved, buyers may open a dispute or support case. Refunds are processed according to our dispute and refund policies through the original payment method.
Reviews
Buyers may leave reviews for purchased items. Reviews should be honest and based on actual transactions. We may remove reviews that are abusive, fraudulent, or violate our policies. Sellers may respond to reviews but may not manipulate or incentivize them.
Messaging
The marketplace provides messaging between buyers and sellers. You agree not to use messaging for off-platform transactions, harassment, spam, or any unlawful purpose. We may review messages for safety and policy enforcement.
User Content
You retain ownership of content you submit to the marketplace, including listings, photos, reviews, and messages. By submitting content, you grant us a license to display it on the marketplace for the purpose of operating the service. You represent that you have the right to submit all content you post and that it does not infringe the rights of any third party.
Prohibited Conduct & Prohibited Items
You may not use the marketplace to sell illegal, dangerous, or prohibited items, including but not limited to weapons, illegal drugs, counterfeit goods, adult content, or items that infringe intellectual property rights. You may not engage in harassment, fraud, off-platform solicitation, or any conduct that violates applicable law or our policies.
Moderation
We moderate the marketplace to maintain trust and safety. We may review listings, messages, live shows, and user reports. We may take moderation actions including warnings, chat restrictions, temporary suspensions, permanent suspensions, and listing removal. These actions may be taken with or without notice depending on the severity of the violation.
Account Restrictions, Suspension & Termination
We may suspend or terminate accounts that violate these Terms or our policies. Suspensions may be temporary or permanent. You may delete your account at any time, subject to the retention of certain records as described in our Privacy Policy.
Fees
The marketplace charges fees on transactions, including a marketplace commission and payment processing fees. Fee rates are configured in our system and may change over time. Sellers should review the current fee schedule in their seller dashboard. Buyers may see applicable taxes and shipping costs at checkout.
Intellectual Property
The Sold My Stuff name, logo, and marketplace interface are owned by us. You may not use our intellectual property without permission. Sellers retain ownership of their listing content but grant us a license to display it on the marketplace.
Third-Party Services
The marketplace relies on third-party services for payment processing, shipping, and live streaming. These services are governed by their own terms and privacy policies. We are not responsible for the actions of third-party providers, but we work to select providers that meet our standards for security and reliability.
Disclaimers
The marketplace is provided "as is" and "as available." We do not guarantee that every transaction will be completed successfully or that every item will meet your expectations. We are not a party to transactions between buyers and sellers but provide a platform for them to transact. We are not responsible for the actions of individual buyers or sellers.
Limitation of Liability
To the maximum extent permitted by law, Sold My Stuff shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the marketplace. Our total liability for any claim arising from these Terms is limited to the amount you have paid us through the marketplace in the preceding 12 months.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the marketplace after changes constitutes acceptance of the updated Terms.
